Terms of Service & EULA

Mellott.US is a personal and family cloud platform operated at https://mellott.us, accompanied by native iOS/iPadOS/macOS applications, native Android applications, and official Browser Extensions. It provides authorized account holders with encrypted cloud storage, password vault management, notes, calendar, photos, messaging, automation, and operational tools.

By accessing or using Mellott.US, our mobile apps, or our browser extensions, you agree to be bound by these Terms of Service, our Privacy Policy, and our Acceptable Use & Anti-Spam Policy. You must be at least 18 years of age (or have verifiable parental or guardian consent within an authorized family group) to use the service.

You are responsible for safeguarding your credentials, passkeys, and multi-factor authentication devices, and for all activity conducted under your account. You may not use Mellott.US to violate any applicable local, state, national, or international law, transmit unsolicited bulk messages (spam), distribute malware, infringe intellectual property rights, or probe, scan, or test the vulnerability of any system or network without authorization. Program Description: Mellott.US offers an opt-in SMS text messaging program for One-Time Passcodes (OTP) / Two-Factor Authentication (2FA), account security alerts, and opt-in operational service campaign notifications. Consent to receive SMS messages is strictly voluntary and is never a condition of any purchase or service access.

Opt-In & Opt-Out: You may opt in via our public SMS Opt-In Form, by texting START to our designated messaging number, or within your authenticated account settings. You may opt out at any time by replying STOP (or STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT) to any message, or reply HELP for assistance.

Frequency, Rates & Carrier Disclaimer: Message frequency varies based on your account activity and security events. Message and data rates may apply. Wireless carriers (including AT&T, T-Mobile, Verizon, UScellular, and regional carriers) are not liable for delayed or undelivered messages. Mobile numbers and SMS opt-in consent data are never sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. Mellott.US uses Twilio SendGrid to deliver essential transactional emails (authentication codes, security notices, password resets, and account alerts) and opt-in operational or product campaign emails. All campaign and non-essential emails comply with the US CAN-SPAM Act, Canadian Anti-Spam Legislation (CASL), GDPR, and the Twilio SendGrid Email Policy.

You may unsubscribe from non-essential or campaign emails at any time using the one-click unsubscribe link included in every email footer or by submitting your address on our public Email Unsubscribe & Preferences Page. Opting out of promotional or campaign emails does not disable mandatory security or account recovery emails.

If you grant notification permissions in your web browser, iOS/iPadOS/macOS device, or Android device, Mellott.US will send push notifications via W3C Web Push (VAPID), Apple Push Notification service (APNs), or Google Firebase Cloud Messaging (FCM) for security approvals, 2FA prompts, messages, and configured reminders. You may disable push notifications at any time in your device or browser settings or under Settings → Notifications.

Scope of License: Subject to these Terms, Mellott.US grants you a revocable, non-exclusive, non-transferable, limited license to install and use the Mellott Cloud mobile applications on Apple-branded products running iOS/iPadOS/macOS that you own or control (as permitted by the Apple Media Services Terms and Conditions) and on Android devices that you own or control (as permitted by the Google Play Terms of Service).

Acknowledgement & Maintenance: These Terms are concluded between you and Mellott.US only, and not with Apple Inc. (“Apple”) or Google LLC (“Google”). Mellott.US, not Apple or Google, is solely responsible for the Licensed Application and its content, maintenance, and support services. Neither Apple nor Google has any obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.

Product Claims, Warranty & IP: To the maximum extent permitted by applicable law, neither Apple nor Google will have any warranty obligation whatsoever with respect to the Licensed Application. Mellott.US, not Apple or Google, is responsible for addressing any claims by you or any third party relating to the Licensed Application, including product liability claims, legal or regulatory compliance claims, consumer protection or privacy claims, and intellectual property infringement claims.

Legal Compliance & Sanctions: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Third-Party Beneficiary: You acknowledge and agree that Apple, and Apple’s subsidiaries, and Google, and Google’s subsidiaries, are third-party beneficiaries of these Terms as related to your license of the respective mobile application, and that upon your acceptance of these Terms, Apple and Google will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

Mellott.US provides official browser extensions for Chromium-based browsers and Mozilla Firefox to enable zero-knowledge password vault autofill, passkey authentication, and encrypted session tools. Your use of the Browser Extension is governed by these Terms and our Browser Extension Privacy & Permissions Policy, which incorporates the Chrome Web Store User Data Policy and Limited Use requirements.

You retain full ownership of all files, photos, vault items, notes, and data you store on Mellott.US. We claim no ownership or commercial license over your content beyond the limited technical right required to encrypt, store, back up, and transmit your data at your direction. You may export or permanently delete your content and account at any time inside the app or via our public Account & Data Deletion Page.

THE SERVICE, MOBILE APPLICATIONS, AND BROWSER EXTENSIONS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MELLOTT.US OR ITS OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE.

You may stop using the service at any time. We may suspend or terminate access that violates these Terms or our Acceptable Use & Anti-Spam Policy. Opting out of SMS or email notifications never terminates your account. These Terms are governed by the laws of the United States and the State of Pennsylvania, without regard to conflict-of-law principles.
